2. About These Terms
These Terms govern:

Your use of dolovent.co.uk;

Consumer orders placed through our website;

Customer accounts, reviews and other website facilities; and
-
Your legal relationship with Dolovent, a brand of Made By Daily.
Please read these Terms before using our website or placing an order.
When you place an order, you are making an offer to purchase under these Terms. Our acceptance of that offer is explained in section 8.
Any contract between you and Made By Daily will be communicated in English.
You must be at least 18 years old, or have the involvement and permission of a parent or legal guardian, to place an order.

4. Where We Sell
We sell to customers in a range of countries. The destinations, products, shipping services and currencies available for a particular address will be confirmed through our website and at checkout.
Some products may not be available in every country due to legal, regulatory, carrier, customs, or import restrictions.
Nothing in these Terms removes any mandatory consumer-protection rights that apply in the country where you live.
5. Consumer and Business Purchases
These Terms are principally intended for consumers purchasing for personal use.
If you purchase products wholly or mainly in connection with your trade, business, profession or practice, you are acting as a business customer. Any separate Practitioner, Affiliate or Trade Terms presented to you will also apply and will take priority where they conflict with these Terms.
Consumer-only cancellation and other statutory consumer rights may not apply to a business purchase.
Unauthorised commercial resale of our products is not permitted. Approved practitioners, distributors and trade customers must comply with their applicable commercial agreement.
6. Product and Health Information
We take reasonable care to ensure that product descriptions, ingredients, directions, warnings and other information are accurate when published.
Product packaging, labels or presentation may occasionally change. Any product supplied will materially correspond with the description accepted when the contract was formed. We will notify you before dispatch if a material change affects your order.
You must read and follow the label, instructions, intended purpose, warnings, storage instructions and recommended intake supplied with the product.
Food supplements
Food supplements are not intended to substitute for a varied, balanced diet and healthy lifestyle.
Except where expressly and lawfully stated for an authorised or registered product, information concerning food supplements is not intended to diagnose, treat, cure or prevent disease.
General health information
Articles, videos, guides, social media content, customer service information, and other educational materials are provided for general information purposes. They are not a substitute for individual medical diagnosis or advice from an appropriately qualified healthcare professional.
You should seek professional advice before using a product if you:

Nothing in this section limits our responsibility for supplying products that are safe, of satisfactory quality, fit for any purpose made known to us and as described, as required by applicable law.
7. Customer Accounts
You may be able to place an order as a guest or create a customer account.
You are responsible for:

Keeping your login credentials confidential;

Restricting access to your account; and

Notifying us promptly if you believe your account has been used without permission.
You must not impersonate another person, create an account using false information or use another person’s payment details without authority.
We may suspend an account where reasonably necessary to investigate suspected fraud, unlawful use, security concerns or a material breach of these Terms. This will not remove any existing refund, delivery or statutory rights.
8. Placing an Order and Contract Formation
Products displayed on our website are invitations to place an order and are not, by themselves, an offer capable of acceptance.
When you place an order, you make an offer to buy the products in your basket. Please check your order, delivery information and payment details before submitting it.
We will send an order acknowledgement once we receive your order. This acknowledges receipt but does not necessarily mean that we have accepted the order.
Unless we expressly tell you otherwise, the contract is formed when we send you confirmation that the order has been dispatched.
Pre-orders, subscriptions, and other purchase options may have different acceptance processes, which are clearly explained before purchase.
We may decline an order before acceptance for a legitimate reason, including:

The product being unavailable;

An inability to deliver to the address supplied;

Payment not being authorised;
-
A suspected fraudulent or unlawful transaction;

Breach of a clearly disclosed quantity restriction;

Suspected unauthorised commercial resale;

An obvious pricing or product-description error; or
-
A legal or regulatory restriction preventing supply.
If we decline an order after taking payment, we will refund the amount paid for the affected products and related shipping charges.
Once an order has been accepted, we will not cancel it merely because we have changed our mind. We may cancel where performance becomes unlawful or impossible, where fraud or a serious breach is established, or as otherwise permitted by applicable law. In that event, we will refund all amounts paid for products that will not be supplied.
9. Products and Availability
All orders are subject to availability.
If a product becomes unavailable after you order it, we will contact you. We will not substitute a materially different product without your agreement.
We may impose reasonable purchase limits where necessary to manage restricted stock, prevent fraud or ensure fair availability. Any limit should be stated on the relevant product or promotional page.
Images are provided to help identify and illustrate products. Colours and apparent sizes may vary slightly due to packaging changes and your device's display, but this does not entitle you to a materially different product.
10. Prices, Taxes and Payment
The price payable is the price displayed for your selected market and confirmed at checkout when you place your order.
Prices will include or exclude applicable taxes as clearly indicated at checkout. Shipping charges and any other unavoidable charges payable to us will be displayed before you submit the order.
International orders may incur import duties, taxes, customs clearance charges, or brokerage fees, as explained in our Shipping Policy.
We accept the payment methods displayed at checkout. Payment may be authorised or taken when you submit the order, even though the contract may not be accepted until dispatch.
If we identify an obvious pricing error before accepting your order, we will contact you and offer you the option to purchase at the correct price or cancel for a full refund. We will not rely on a minor or non-obvious pricing error to unfairly alter an accepted consumer order.
11. Delivery
Available shipping services, charges and estimated delivery times are set out in our Shipping Policy and confirmed at checkout.
Delivery dates are estimates unless a service is expressly described as guaranteed.
We remain responsible for the goods until they are delivered into the physical possession of you or a person you have nominated, except where you independently arrange a carrier that we did not offer.
Please contact us if your order is late, missing or damaged in transit. Your legal rights relating to non-delivery, late delivery or damaged goods are unaffected.
Ownership of the goods passes to you when we have received full payment, and the goods have been delivered.
12. Cancellation, Returns and Refunds
Our Returns and Cancellation Policy explains how to cancel an order, make a return and obtain a refund.
For most UK and EU online purchases, you may notify us of your intention to cancel between the date of purchase and 14 days after receiving the goods. You will then normally have another 14 days in which to return them.
Exceptions may apply, including to sealed goods that are unsuitable for return for genuine health protection or hygiene reasons, where the seal has been broken after delivery.
A return authorisation helps us identify and process your parcel, but failure to obtain or include an authorisation code will not waive your statutory cancellation or refund rights.
Where the statutory cancellation right applies, we will refund the product price and the cost of our least expensive standard outbound delivery service. You may be responsible for return postage unless the product is faulty, damaged, incorrectly supplied or our policy states otherwise.
Your rights concerning products that are faulty, unsafe, damaged, unfit for purpose or incorrectly described are separate from the right to change your mind and are not limited by our commercial returns period.
Customers outside the UK and EU will have the rights described in our Returns Policy together with any mandatory rights under the law applicable to them.
12A. United States returns, cancellations and refunds
United States customers may return eligible products in accordance with the USA Returns section of our Returns and Cancellation Policy. That policy forms part of these Terms and explains the applicable notification period, product condition requirements, return procedure, return label charges, refund method, and any exclusions.
Our return period for unwanted products is a voluntary change-of-mind return policy and is not intended to constitute a general statutory cancellation right. The return policy in force when you place your order will apply to that order.
Products returned because you have changed your mind must be unused, unopened and in their original packaging, with any health, hygiene or tamper-evident seals intact. These restrictions do not limit any rights or remedies available under applicable federal or state law where a product is faulty, damaged, unsafe, materially misdescribed, incorrectly supplied or not delivered.
Any charge for a return shipping label will be disclosed in our Returns and Cancellation Policy and deducted from the refund where permitted by applicable law.
Nothing in these Terms or our Returns and Cancellation Policy excludes or restricts any consumer right that cannot lawfully be excluded or restricted under applicable United States federal or state law. Where the law of a customer’s state provides greater protection, that law will apply.
12B. Canadian returns, cancellations and refunds
Canadian customers may return eligible products in accordance with the Canada Returns section of our Returns and Cancellation Policy. That policy forms part of these Terms and explains the applicable notification period, product condition requirements, return procedure, return label charges, refund method, and any exclusions.
For an unwanted product, you must notify us within seven calendar days after receiving your order. Once we issue your Returns Authorisation and return shipping label, you must send the product back within a further seven calendar days.
Our seven-day return period is a voluntary change-of-mind return policy. It does not replace or restrict any cancellation, refund, warranty or other rights available under applicable Canadian federal, provincial or territorial law.
Products returned because you have changed your mind must be unused, unopened and in their original packaging, with any health, hygiene or tamper-evident seals intact. Change-of-mind returns that do not meet these conditions may be refused.
These restrictions do not limit any rights or remedies available where a product is faulty, damaged, unsafe, materially misdescribed, incorrectly supplied or not delivered. Where we have supplied an incorrect, damaged, or defective product, we will pay the reasonable return costs, as required by applicable law.
Canadian orders are currently fulfilled from our United States warehouse. Applicable customs duties, import taxes, brokerage charges and other cross-border fees will be disclosed at checkout where they are collected by us. Where they are not collected at checkout, the customer may be responsible for paying them directly to the relevant authority or carrier.
For a voluntary change-of-mind return, the cost of the return shipping label will be disclosed before the return is confirmed and deducted from the refund. Original delivery charges, customs duties, import taxes and brokerage charges are not refundable unless required by applicable law or unless the return results from our error.
Nothing in these Terms or our Returns and Cancellation Policy excludes or restricts any consumer right that cannot lawfully be excluded or restricted under applicable Canadian federal, provincial or territorial law. Where applicable law provides the customer with greater protection or a longer cancellation period, that law will prevail.
12C. Other North American and International Destinations
Customers in Mexico and other North American or international destinations may return eligible products in accordance with the International Returns section of our Returns and Cancellation Policy.
Any return period we offer for an unwanted product is a voluntary change-of-mind return policy. It does not replace or restrict any mandatory cancellation, refund, warranty or other consumer rights available under the law applicable to the customer.
Nothing in these Terms excludes or restricts any consumer right that cannot lawfully be excluded or restricted. Where applicable local law provides the customer with greater protection, that law will prevail.
13. Subscriptions and Pre-orders
Subscriptions and pre-orders are governed by our Purchase Options and Cancellation Policy and the specific information displayed before purchase.
For subscriptions, this includes:

The recurring price;

Charging and delivery frequency;
-
Minimum commitment, if any;
-
Automatic renewal;
-
Trial or introductory pricing;
-
How to manage or cancel; and
-
How cancellation affects an order already in processing.
For pre-orders, this includes:

The amount payable at checkout;
-
Any remaining payment;
-
When the balance will be charged;
-
The estimated availability or dispatch date; and
-
The right to cancel before dispatch.
Nothing in the Purchase Options and Cancellation Policy limits mandatory statutory rights.
14. Promotions, Discounts and Free Gifts
A promotion may be subject to additional terms shown on the promotional page, in an advertisement, in an email, or at checkout.
Unless the offer-specific terms say otherwise:

Promotions are available for a limited period and while stocks last;

Only one promotional code may be used per order;
-
Promotional codes cannot be applied retrospectively;
-
The promotion has no cash alternative;
-
It may not be combined with another offer;
-
Reasonable per-customer, per-household or per-order limits may apply; and
-
Practitioner, affiliate, trade and specified products may be excluded where this is clearly disclosed before purchase.
We may withdraw or change a promotion prospectively. This will not affect an order already accepted under that promotion.
We may reject misuse of an offer, including fraudulent accounts, unauthorised code distribution or attempts to evade a clearly disclosed purchase limit.
If a qualifying order containing a free gift is cancelled or returned, the offer-specific terms may require the unopened free gift to be returned. Any deduction for an unreturned gift must have been clearly disclosed and must be permitted by applicable law.
Any promotion-specific restrictions, including excluded products, practitioner eligibility, and the number of free items, should be displayed prominently with that particular offer.
15. Reviews and Public Contributions
You may be able to submit reviews, comments, photographs or other content intended for public display.
You retain ownership of your content. By submitting it for publication, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display it in connection with our website, products and marketing, for as long as the content remains published or as reasonably necessary to administer its previous use.
You must not submit content that:

is false or misleading;
-
infringes another person’s rights;
-
contains personal or confidential information about another person;
-
is defamatory, threatening, discriminatory, obscene or unlawful;

contains malicious software or commercial spam; or
-
makes unlawful or unsubstantiated medicinal or health claims.
We may moderate or remove content where reasonably necessary for legal, regulatory, safety or relevance reasons. We will not selectively alter genuine reviews in a way that misrepresents customer opinion.
Information sent privately through customer service, a privacy request, a product safety report, or a health enquiry is not treated as public user-generated content and is handled in accordance with our Privacy Policy.
16. Intellectual Property
Unless otherwise stated, the website and its content, including text, graphics, photographs, videos, logos, product names, designs, software and layout, are owned by or licensed to Made By Daily and are protected by intellectual-property laws.
You may view the website and download or print reasonable extracts for personal, non-commercial use.
You may not, without prior written permission:

Reproduce or commercially exploit substantial website content;

Modify or republish our content as your own;

Remove copyright, trademark or attribution notices;

Use our trademarks in a way that suggests endorsement or affiliation;

Third-party terms and privacy policies may apply when you use their services.
We are not responsible for the content or practices of an independent third-party website merely because we provide a link to it. This does not exclude responsibility where we have expressly adopted third-party content or where the law otherwise makes us responsible.

Our collection and use of personal information is explained in our Privacy Policy and Cookie Policy.
Information entered into forms may be shared with service providers, where necessary, to process the request, fulfil an order, provide customer service, or operate the website, as described in the Privacy Policy.
20. Website Availability and Accuracy
We take reasonable care in operating the website but cannot promise that it will always be uninterrupted, secure or free from technical errors.
We may temporarily suspend access for maintenance, security, updates or circumstances outside our reasonable control.
We will take reasonable steps to correct material errors brought to our attention. Nothing in this section permits us to avoid responsibility for inaccurate product information that forms part of an accepted contract or for misleading commercial claims.
21. Our Responsibility to Consumers
We are responsible for losses that are a foreseeable consequence of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for a loss that was not reasonably foreseeable when the contract was formed, or for a loss caused solely by information or circumstances you failed to disclose to us.
If you are a consumer, we are not responsible for business losses, including loss of profit, revenue, opportunity or business interruption, arising from a product purchased wholly for personal use.
Nothing in these Terms excludes or restricts liability for:

death or personal injury caused by negligence;

fraud or fraudulent misrepresentation;

defective products where liability cannot legally be excluded;

breach of statutory rights concerning goods or services;

deliberate misconduct; or

any other liability that cannot lawfully be excluded or restricted.
Nothing in these Terms affects your statutory consumer rights.
22. Events Outside Our Reasonable Control
We are not responsible for delay caused by an event genuinely outside our reasonable control, provided that we take reasonable steps to reduce the effect of the event and contact affected customers where appropriate.
This may include serious carrier disruption, natural disasters, industrial action not involving our own workforce, war, government restrictions, widespread infrastructure failure, or public health emergencies.
If the delay is substantial, you may be entitled to cancel the affected order and receive a refund for goods not supplied.
23. Changes to These Terms
We may update these Terms to reflect changes in law, our services, technology or business operations.
Changes apply prospectively from the date the revised Terms are published. The terms in force when we accepted an order will continue to govern that order.
Material changes affecting an existing subscription will be notified in accordance with our Purchase Options and Cancellation Policy and applicable law.
24. Governing Law and Courts
These Terms and contracts between you and Made By Daily are governed by the law of England and Wales.
If you are a consumer outside England and Wales, this choice does not deprive you of any mandatory protections given to you by the law of the country in which you normally live.
The courts of England and Wales have non-exclusive jurisdiction. A consumer may also bring proceedings in any local court that has jurisdiction under applicable consumer law.

If a consumer dispute remains unresolved, we will provide information about any approved alternative dispute-resolution body that we are required to identify and whether we are required or willing to participate in that procedure.
Privacy complaints are handled in accordance with our Privacy Policy.
26. General Provisions
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
If we delay enforcing a provision, this does not mean that we have waived our right to enforce it later.
No person other than you and Made By Daily has a right to enforce these Terms, except where applicable law provides otherwise.
